Court accepts Abhisit draft case

The Administrative Court on Friday accepted Democrat Party leader Abhisit Vejjajiva's petition against Defence Minister ACM Sukumpol Suwanatat's order stripping him of his military rank.

The court also ordered ACM Sukumpol to explain his decision within 30 days.

The minister revoked the opposition leader's military rank on Nov 8 on grounds that Mr Abhisit had used fake documents to become a lecturer at Chulachomklao Royal Military Academy, a job that exempted him from the army in 1987.

Disc 18 - Maybe you didn't understand my post. Abhisit cannot be found innocent or guilty by the administrative court. Only the procedure used to pull his rank can be ruled on.

Why would the PT worry about Abhisit in the debate? They had a majority and could easily vote themselves out of anything even at the expense of loosing support. I believe had nothing to loose going into the debate as there was nothing new to bring up other than quoting an un named source. which is a typical move of the Dem party. If the source does not show up it's just a rumor.

# 17, we take your view point just like we all exchange views here. But there is one important difference we ALL including Abhisit will accept the legal verdict handed down. If Abhisit is found guilty, so be it. But on your side, will you accept the court verdict? Or will you challenge it on the streets and on stage, will you threaten the judges, will you reveal personal details including phone numbers of the judges? Will you encourage your supporters to kidnap the judges? Those are some worrying questions. After all you hate a coup and we do the same too, but we would hate a coup being replaced by any other form of authoritarian rule too.

Some things all posters should consider. The Administrative court can only rule on procedural matters. They cannot rule on Abhisit's guilt or innocence. The Administrative court has no precedent to overrule a military court. The Administrative court can be overruled by Parliament, the Senate, the Supreme court, the EC and the Constitutional court ( and possibly the Criminal court).

Whatever the ruling of the Administrative court Abhisit will still be guilty under Military law. And those calling for Sukumpol's resignation - the devil you know is better than the alternatives.

D8@domdunnn - the article clearly states Khun Abhisit has denied the claims that he used false papers. His guilt or innocence should be determined in a properly constituted court of law, not by some 'kangaroo' process lead by the Def. Minister, which did not even involve the military court system. The first issue to determine is if the military still have jurisdication over an individual who has long left the service. If not the right place to deal with this is through the civilian court system - which would also be logical as his alleged offence must have been committed as a civilian since it occurred before his military service

Domdunn # 937: Abhisit is challenging Sukumpols authority, he is also denying that he used false documents. Let us get logical and stop political sides, the law is the law. It does look as if Sukumpol is in trouble, I have nothing against Sukumpol though, but the problem exists with his advisors who wrongly advised him. It is time the reds who are so pro red and anti-everything else, start seeing things for what they are worth. Every red seems so scared to go against their master's dream that they have all become blind yes men. Like I said late last night in these columns, there is NO room for protests or slogans - the law is the law.

I'm guessing this is going to develop into quite a case, the military must be seething that Sukumpol interfered to have rank stripped from their ally. It was a petty, unnecessary thing to do that is probably going to backfire if the courts see to it that the Defence minister is impeached. Thaksin tried too hard to exert the govt's influence over internal army matters and his man will be legally removed. It's one thing to expect the army to co-operate and respect the govt of the day, but when they start abusing that privilege you can expect a mutiny (not a coup), similar to running a business where the boss overrides the middle management.

with numerous problems about to hit Thailand I find this ridiculous case quite disgusting and offensive...its about time PT started to help Thailand's population instead of treating the population as total idiots

Whatever PT and their cronies think Thailand is in turmoil and its about time ALL politicians who take the oath of office actually stand by it
