Vendors who sell falsely labelled counterfeit products valued at more than 500,000 baht could face the seizure of their personal assets in the foreseeable future, the Commerce Ministry warned on Monday.

Deputy Commerce Minister Nattawut Saikuar said this was being considered as part of the ministry's commitment this year to tighten its efforts to tackle intellectual property violations.

An amendment bill to the Anti-Money Laundering Act 1999, which makes intellectual property theft a predicate offence, has already been passed by parliament and is awaiting royal appoval, he said.

It is quite clear that this law applies to big scale businesses only. small scale businessmen can go on with their usual act of selling pirated or counterfeit products”?

It would be nice if the government used a 'predicate offence' law against politicians that hire canvassers to buy votes, or school administrators that extort parents for student enrollment, or police that take bribes. Seizing assets from these miscreants might go a long way towards curbing corruption. But what would become of the seized assets?

So all the vendors selling counterfeit goods will simply make sure they have less than 500,000 baht worth in stock at any point in time.

Now there's a deterrent to copyright and IP infringement. Of 8,400 cases there were 50, less than 1%, were for over 500,000 baht. So under this law what happens to the other 8,350 cases. And don;t you think these guys will be smart enough to limit their exposure to well below the specified limit. Another knee jerk reaction to an out of control situation.

Exactly how much is “500,000 baht worth of pirated or counterfeit products”?
Are i.e. 10 copied LV bags worth more than 500,000B because this is what the originals would cost in the official shops or are 1,000 of the same bags not enough because the pirated goods seller bought them for less?
I think the whole thing is a joke. The same people sell the same products at the same places for years and our authorities did nothing about this for at least a decade. Is that because there are no laws in Thailand or because they are ignored by everyone – especially by the police?
