The Central Criminal Court for Corruption and Misconduct Cases has upheld the lower court's ruling in favour of the Bangkok governor and his senior staff for not changing the name of Sutthisan Vinitchai Road back to Inthamara Road.
The lower court threw out the case on the grounds that the governor and related City Hall officials did nothing which constituted negligence of duty in not changing the road's name.
Descendants of the Inthamara family lodged the court action against Bangkok governor Aswin Kwanmuang, city clerk Pattharut Thantranont, deputy city clerk Wanchai Thanomsak, Phaya Thai district chief Kanokrat Pannara, Din Daeng district chief Sanyakorn Oonmeesri and Phanupong Suthisan.
The family filed the case with the Central Criminal Court for Corruption after City Hall failed to carry out the name change ordered by the Supreme Administrative Court on July 20 last year. The family said the order was to revert the road's name back to Inthamara within 180 days of the court's order. However, the deadline has lapsed and no change was made.
The failure to implement the change amounted to negligence of duty, which the family argued was grounds for submitting the case to the Central Criminal Court of Corruption.
The lower Central Criminal Court for Corruption, however, dismissed the case, saying the governor and his staff did not commit negligence of duty, according to Krissada Inthamara.
The court said City Hall had surveyed opinion, in line with the Administrative Court order. The survey showed most people preferred to use Sutthisan Vinitchai, Mr Krissada said.
